Easydom Glass 3S display guarantee conditions

EASYDOM I.N.C. commits itself to provide products of highest quality.

In order to produce Easydom Glass 3S we use some of the most advanced industrial production processes and strict quality control procedures.

However, sometimes it's possible to find defects in the pixels of LCD TFT’s panels used for flat screen monitors.

No producer is able to guarantee that all panels are without pixel’s defects, but EASYDOM I.N.C. guarantees that any monitor, with an acceptable number of defects (see point n.6), will be repaired or substituted under guarantee.

1. DEFINITIONS.

PRODUCER: it means EASYDOM I.N.C. society, as it’s authorized to sell hardware products with Easydom’s brand.

CONSUMER: it means the natural person who act for purposes extraneous to the business or professional activity done (art. 3 of the Code of Consumption).

CUSTOMER: the natural, legal person or the professional who buy Easydom product.

SELLER: who is authorized to sell Easydom products. He can be the Installer and Experience when they resell/install Easydom hardware products to the Customer.

EXPERIENCE: it’s an authorized zone reseller, who carries out its business through a store realized in conformity with regulations imposed by Easydom.

INSTALLER: it means Easydom Certified Installer. They are selected professionals who attended and passed specific training courses, that certified its skills and competence in evaluating Consumers’ needs, suggesting the best solutions and offering the best Easydom domotic technology.

Please notice that EASYDOM I.N.C. does not assume any responsibility, duty and/or committment concerning the work and activities done by the Installer, and for any loss or damage related to any business, commercial activity or profession carried out by the Customer or by any other person using the product bought, according to the following Conditions.


2. OBJECT AND PRACTICALITY OF THE GUARANTEE.

A Legal guarantee, pursuant to the regulations of the art. 128 and following of the Consumption’s code (Legislative Decree 6th September 2005 n.206) is recognized to the Customer, who buys Easydom products through an Easydom authorized sales channel (Installer or Experience).

According to the law in question, the Customers have the right to obtain from the Seller the reparation or substitution of the products which have original defects. The term by which the defects’ report must be communicated, depends on whether the Customer is:

- A natural person who uses the product for purposes different from the business or professional activity carried out. In this case the defect must be noticed within 24 (twentyfour) months starting from the product’s delivery date, except for the parts which are naturally subject to usage deterioration. The interested must signal the defect of the component by 60 (sixty) days from its discover;

- A legal person, a professional as well as someone who uses the product for its own professional, commercial and business activity. The defect must be recognized within 12 (twelve) months, starting from the date showed on the delivery document. In this case the defect of the product must be signaled by 8 (eight) days from its discover.


3. GUARANTEE AND ASSISTANCE’S VALIDITY.

This guarantee conditions are valid exclusively in Italy, including the San Marino Republic and the Vatican City, and only in the case the Customer has purchased Easydom Glass 3S from an Installer or through an authorized dealer (Experience).

For the guarantee to be fully valid and for the Assistance to be used, it’s necessary that:

- the purchase of Easydom Glass 3S is documented;

- the product’s installation and connection to the energy networks are done following the instructions for installation that go with the product;

- all uses of Easydom Glass 3S follow the instructions and specifications written in the Instruction Guide;

- any reparation is done by Certified Installers;

- Easydom Glass 3S’s receipt of payment is provided.


4. GUARANTEE’S OBJECT.

In accordance with the law ISO 13406-2, Easydom Glass 3S is included in the Class II, Type 3.

The presence of colour points defects (Bright or Dark) on the Display (dead pixel) is considered acceptable by ESOURCE S.r.l. if it’s up to a total number of 5 (five) pixel and/or if the distance among the damaged pixels is greater or equal t 10 (ten) mm.

Therefore, the guarantee considers the Display defective only if the colour defects (Bright or Dark) are more than 5 (five) pixel and/or the distance among the damaged pixels is less than 10 (ten) mm, independently from the screen’s geographical area in which the defect is appeared.

In case of similar defects, reported according to the terms of point n.2, EASYDOM I.N.C. will commit itself to repair, as well as substitute the screen.


5. INTERVENTION REQUEST.

Once the defects have been detected as in the point n.4, it’s necessary that the Customer contacts the Seller within the term specified in point n.2 in order to make the guarantee operative.

In case the Seller would not be available to intervene, or he could not be reached, the Customer can contact another and different Seller, identifying the name in the list of Easydom Certified Installers or Experience, published on the website www.easydom.com.

The new intervention’s costs are at Customer's expense, who could obtain protection for his rights and asserts his claims toward the defaulting Seller, taking legal actions.


6. TECHNICAL ASSISTANCE

Whoever owns an Easydom Glass 3S, could count on the guarantee protection turning directly to the Seller, he could request Easydom technical assistance thanks to the assistance ticket opening, using the “Support” area included in the “Customer Area” section of the website www.easydom.com.

With reference to this, it’s necessary that the Customer has the document proving the purchase and/or the delivery, that clearly show the Seller’s name and the date in which the sale has occurred, in order to demonstrate the guarantee’s validity.

It must be noticed that the chance to use Easydom Technical Assistance, is subject to the full payment of the purchased products.


7. SELLER’S BURDENS.

The Seller will take charge of the intervention’s request of the Customer, in order to examine the product, check the defect reported, and to evaluate if there are evident causes for the guarantee’s exclusion (for example coverage expiration, presence of accidental damages or damages caused by the Customer, number of pixel burned).

In order to allow ESOURCE’s reparation or substitution, the Seller will have to contact Easydom Technical Support and, under its instructions, give back Easydom Glass 3S to Easydom Technical Assistance Centre.

The transport costs for Easydom Glass 3S’s delivery are at the expense of the Seller.

In addition, at the product reception, the Assistance Centre reserves the right to certify the guarantee validity.


8. GOODS’ CHECK.

Before accepting the delivery, the Customer has to carefully control the package conditions.


9. ADDITIONAL CLARIFICATIONS.

The reparations and substitutions made beyond the guarantee term will be debit to the Customer at the price in force at the moment of reparation.

EASYDOM I.N.C. declines any responsibility for potential damages to persons, domestic animals or things, direct or indirect, caused by the lack of observance of Easydom Glass 3S’s installation instructions and, especially those concerning the instructions, use and maintenance of it.

No reimbursement is recognized for the inoperative period of Easydom Glass 3S.


10. PERSONAL DATA’S PROTECTION

According to and for the effect of the Privacy law ex. Legislative Decree196/03, the personal data communicated by the buyer during the assistance ticket completion, will be elaborated by EASYDOM I.N.C. with informative and manual tools, exclusively to allow the buyer benefit from this guarantee and to facilitate the Assistance Centre intervention authorized by ESOURCE S.r.l., as well as for management purposes related to the exercise of producer’s economic activities and for statistical, marketing and commercial purposes related to the activity carried out by ESOURCE S.r.l..

The data are collected and stored on servers localized in Italy and they will not be spread.

These data could be communicated to subsidiaries, parent companies and/or connected or belonging to the same group, both inside and outside the European Union.

The personal data collected will be accessible by the bodies and employees of EASYDOM I.N.C. formally designated as Appointee or Responsible for their use, they could be communicated to subjects appointed by EASYDOM I.N.C. for purposes related to the organization of the guarantee, assistance and maintenance service and for statistical, marketing and commercial informative purposes.

The Users who have provided their personal data according to this informative, benefit from all the rights attributed by the Code.

For the potential claims of the rights included in art. 7 of Legislative Decree 196/03, the buyer could turn to ESOURCE S.r.l., Via del Caravaggio n. 3 - 20144 Milan, which is the Holder of data use. According to the same article, they have the right to obtain the cancellation, transformation to anonymous or the block of data used in violation of law, as well as opposing to their use for legitimate reasons.


TYPES OF PIXELS' DEFECTS

1. PIXEL AND SUBPIXEL

A pixel, or an image element, is the small spot that we recognize in a LCD screen when this last remains black or blue, etc...

A pixel is made up of three sub-pixels of fundamental colours red, green and blue. Many pixels together make an image. When all the sub-pixels of a pixel are lighted up, the three coloured sub-pixels appear as a single white pixel. When they are dark, the three coloured sub-pixel appear as a single black pixel.

 

Due to the complexity of the manufacturing process, it must be taken into account that impurities could infiltrate into the LCD panel and, as time passes, they can lead to defects.


2. PIXELS' DEFECTS

Pixels and sub-pixel's defects appear on the screen in different manners.

The law ISO 13406-2 reveals that the defective pixels can be of four types and it specifies how many defective pixels (in a million) can be present in a monitor before considering it defective.

The categories are:

Type 1: bright points defects.

This type of defect appears when some pixels or sub-pixels remain always "lighted up", that means a cell is always bright. It shows itself as a small white square.

Type 2: dark points defects.

The defects caused by dark points appear when some pixel or sub-pixels are always dark or "turned off". In this case the cell is always turned off, and it shows itself as a small black square.

Type 3: turned on/off R, G, B subpixel.

In this case, one of the three subpixels which make a cell, remains turned on (green, red and blue) or turned off (in this case your eye will perceive the colour resulting from the two turned on).

Type 4: Pixel Cluster Failure.

In this last case it should be respected pixels' contiguity within an area of 5x5 pixels on the panel.


3. PIXELS DEFECTS PROXIMITY AND TOLERANCE

In order to allow the Consumer to identify the cases in which he can request the substitution or reparation of the LCD panel under guarantee, the chart below specifies the number of defective elements which exceed the tolerance.
